GILLETTE, Wyo. — On Tuesday, the Campbell County Board of Commissioners reclassified the sales manager and senior sales manager positions at CAM-PLEX from exempt to non-exempt status under the Fair Labor Standards Act.
The reclassification was initiated after an administrative review revealed the previous exempt status did not align with the actual work duties of the employees. The FLSA provides specific criteria for determining whether a position qualifies as exempt, and in this case it was determined that the sales manager and senior sales manager positions did not meet those criteria. That’s primarily because the roles supervise processes, not people.
“The federal government essentially trusts the employer to make the correct exempt or non-exempt determination,” said Brandy Elder, executive director of Human Resources. “In this particular case, because of the work duties of the staff, the appropriate classification is non-exempt.”
This reclassification ensures the employees in these positions are entitled to overtime pay and other benefits afforded to non-exempt workers under the FLSA.
