outside of the Christmas party

and they start trying to piece together

what happened.

So they they show up, and then what?

running with this story of,

I think he tried to assault me

and my client is adamant.

I was trying to sleep.

I was in the middle seat.

I didn’t touch her.

00;03;22;14 – 00;03;22;27
You know,

00;03;22;27 – 00;03;25;23
none of this happened and is just,

00;03;25;23 – 00;03;29;02
you know, trying to explain away

00;03;29;02 – 00;03;31;12
what happened that, you know, it

00;03;31;12 – 00;03;33;02
it wasn’t an assault.

And ultimately

the police end up

00;03;36;03 – 00;03;37;15
arresting him for an attempted

00;03;37;15 – 00;03;41;15
sexual assault. Wow. So,

you know, it is it it is a

cultural stereotype

that the man is is the more aggressive

if it’s a man and a woman, you know,

of course, that’s not always true.

actually trained to see it that way?

to make sure that the woman

feels comfortable reporting,

you know, that

she doesn’t feel embarrassed

about her conduct, about being drunk,

about whatever the case may be.

And they really do coddle or suggest,

you know, a storyline to a woman

00;04;21;09 – 00;04;23;26
who maybe was really too intoxicated

00;04;23;26 – 00;04;25;14
to know what went on.

But they’re always suspicious.

And in this type of scenario

that a man is going to be

00;04;31;06 – 00;04;33;01
assaulting a woman. Hmm.

And then the arrest is made,

and then he needs a lawyer

and it might go to trial

00;04;39;03 – 00;04;40;18
where both sides of the story

get to be told that it’s still risky,

that he’s going to end up

convicted for this, right?

Absolutely.

Because any time you start a trial

accused of a sexual assault,

to the possibility

she’d been prepped by the prosecutor.

She, you know, made a statement

to the police that she reviewed.

You know, she she took the stand

00;05;33;19 – 00;05;36;09
as if she recalled perfectly

00;05;36;09 – 00;05;37;09
all the evenings

00;05;37;09 – 00;05;39;17
of all of the events of the evening

00;05;39;17 – 00;05;41;25
that, you know, had transpired

00;05;41;25 – 00;05;43;08
when, in fact, she was

00;05;43;08 – 00;05;44;28
she was highly intoxicated.

But as she was telling or recounting

what happened, she claimed that my client

leaned over the

00;05;54;15 – 00;05;57;10
the seat in the middle seat and

was attempting to unbutton her pants.

And as he’s in

the middle row of the suburban seat and,

00;06;06;10 – 00;06;08;05
you know, she said

00;06;08;05 – 00;06;08;27
and she ended up

00;06;08;27 – 00;06;11;15
using his phone to call 911.

And so as we’re trying to figure out

00;06;13;22 – 00;06;17;07
how she was able to get his phone,

00;06;17;10 – 00;06;19;19
you know, she said, well, as he was

00;06;19;19 – 00;06;22;11
leaning over to assault me,

00;06;22;11 – 00;06;24;23
the phone came out of his front pocket

00;06;24;23 – 00;06;27;10
and, you know, just

00;06;27;10 – 00;06;29;03
there was a body camera footage of him

00;06;29;03 – 00;06;29;25
being interviewed

00;06;29;25 – 00;06;31;22
right after the alleged incident.

00;06;31;22 – 00;06;35;08
And that body camera captured

00;06;35;08 – 00;06;37;00
that he was wearing a t shirt

00;06;37;00 – 00;06;39;05
and it did not have a front pocket.

00;06;39;05 – 00;06;43;03
And so, you know, I was able to

00;06;43;06 – 00;06;45;00
confront her with this

00;06;45;00 – 00;06;46;18
fact that she said,

00;06;46;18 – 00;06;49;14
you know, that she remembered so clearly

00;06;49;14 – 00;06;50;14
and really,

00;06;50;14 – 00;06;54;00
you know, called into question that she

00;06;54;02 – 00;06;56;21
wasn’t able to

00;06;56;21 – 00;06;59;07
really report with any

00;06;59;07 – 00;07;00;26
any amount of certainty

00;07;00;26 – 00;07;03;06
that he was attempting to

00;07;03;06 – 00;07;05;07
to sexually assault her.

00;07;05;07 – 00;07;07;06
And but she was,

00;07;07;06 – 00;07;11;26
you know, testifying very

00;07;11;28 – 00;07;13;29
firmly that this is exactly

00;07;13;29 – 00;07;14;21
what happened.

00;07;14;21 – 00;07;15;29
And, you know,

00;07;15;29 – 00;07;16;22
that’s

00;07;16;22 – 00;07;18;17
that’s just not how it works

00;07;18;17 – 00;07;19;26
in a criminal case.

The jury needs to be convinced

beyond a reasonable doubt

that someone is guilty.

And in this case, there was real doubt

and my client was found not guilty.
